Divorce Summons

INFORM:                   WHITE PEPPER, (Born SALT), an adult female, who is employed as a cashier at Pick & Pay, Boardwalk Centre, RICHARDS BAY, and who resides at 1 Pepper Place, Birdswood,  RICHARDS BAY, KWA ZULU, NATAL
(Hereinafter called the DEFENDANT)

THAT:                        BLACK PEPPER,  an adult male, employed as an engineer at Robinsons Spices, 11 Union Street, EMPANGENI  and who resides at 1 Pepper Place, Birdswood, RICHARDS BAY, KWA ZULU, NATAL
(Hereinafter called the PLAINTIFF),

Hereby institutes an action against her in which action the PLAINTIFF claims the relief and on the grounds as set out in the Particulars of claim annexed hereto.

INFORM:       The DEFENDANT further more that if he/she disputes the claim and wishes to defend the action, he/she shall:

l.          within ONE MONTH to service upon her of this summons, file with the Registrar of this Court, PRIVATE BAG X54304, DURBAN, 4000,  notice of his/her intention to Defend and serve a copy thereof on the PLAINTIFF'S attorneys, which notice shall give an address (not being a post office box or poste restante) for the service upon the DEFENDANT of all notices and documents in the action; such address is one within 8 (EIGHT) kilometres of the office of his Registrar, or if the DEFENDANT in person or his attorney is a person who is in terms of any law prohibited from being the occupier of land or premises within a distance of 8 (EIGHT) kilometres of such office, an address further that 8 (EIGHT) kilometres from such office but within the magisterial district in which such office is situated may be appointed.

2.         thereafter, and within 10 (TEN) days after filing and serving notice of intention to defend as aforesaid, file with the Registrar and serve upon the PLAINTIFF a plea, exception, notice to strike out, with or without a counter claim.

INFORM:       The DEFENDANT further that if he/she fail to file and serve notice as aforesaid, Judgment as claimed may be given against him/her, or if, having filed and served such notice, he/she fail to plead, except, make application to strike out, or counterclaim, judgment may be given against him/them.



AND immediately thereafter serve on the DEFENDANT a copy of this summons and return same to the Registrar with whatsoever you have done thereupon.
