Question 1:

Alison Black and Sloan Black are married out of community of property (inclusive of the accrual system). They got married on the 1st day of April 2003 at Cape Town. Sloan adopted Alison’s minor child from a previous marriage, namely JJ, a boy born 1 February 2002. Alison has been physically abused by Sloan on various occasions in the past.

She instructed you that she is employed as a cashier at Pick & Pay but that she earned an inadequate income to support herself. Sloan is an auditor at PWC, Durban and earns R50 000 per month. Both parties reside in the matrimonial property located at 1 Venus Road, Durban.

1.1        You are instructed to request spousal and child maintenance at the rate of R20 000 and R5000 per month.                                                                                                               [30]

1.2         In lieu of the aforesaid set of facts, what remedies are available to Alison besides
issuing a divorce summons?                                                                               [15]

1.3        Based on the aforesaid set of facts, mention the initial documentation that should be forwarded to the registrar to commence the divorce action and briefly outline the procedure involved in instituting a divorce action.                                                                                                     [15]


Question 2:

2.1        Explain to Alison the procedure involved in applying for maintenance, as well as the criteria the court will apply in considering such an application.                                                         [10]

2.2               Mention and discuss what relief can be claimed in terms of a Domestic Violence order.

Question 3:

Outline the procedure and criteria applied in bringing a R43 application. In answering the said question reference must be made to the relief that can be claimed in terms of a R43 application.
